Terms and conditions (T&C)

These terms and conditions govern the sale of products via the website ai-eyewear.ch as well as in the showroom of Even Realities Switzerland.

1. Provider and scope

The contracting party is Podomedics, Zeltweg 74, 8032 Zürich, Switzerland, company no. CHE-324.165.596 MWST — hereinafter "we". We trade under the brand "Even Realities Switzerland" (ai-eyewear.ch) and are an independent authorised partner and reseller of Even Realities. The contacts are Nicola Mössner (Even Realities Partner Switzerland) and Giovanna Carpi (Business partner); contact: sales@ai-eyewear.ch, phone +41 78 422 46 73. These terms and conditions apply to all orders placed via ai-eyewear.ch as well as to purchases in the showroom. The offer is aimed at customers with a delivery address in Switzerland.

2. Offer and conclusion of contract

The presentation of the products on the website does not constitute a legally binding offer, but rather an invitation to place an order. The purchase contract comes into effect as soon as your order has been completed and payment has been successfully processed via our payment service provider. You will then receive a confirmation by email. Obvious errors in prices or product details are reserved; in such a case we will inform you immediately and fully refund any payments already made.

3. Prices

All prices are stated in Swiss francs (CHF) including the statutory value added tax, currently 8.1 %. The price displayed at the time of the order is authoritative. Any shipping costs are shown before the order is completed.

4. Payment

Payment is processed via the certified payment service provider Stripe (Stripe Payments Europe, Ltd.). Credit and debit cards, TWINT, Apple Pay and Google Pay are available in particular. Your payment data is collected and processed directly by Stripe in encrypted form; we do not receive any complete card details. On your card statement the payment appears as "AI-EYEWEAR.CH". Purchase by invoice/advance payment is possible by arrangement.

5. Delivery

We deliver within Switzerland. Delivery is usually made within 2–7 working days of receipt of payment, provided the product is in stock; we will inform you of any differing delivery times. Alternatively, personal collection at the showroom (Zeltweg 74, 8032 Zürich, by arrangement) is possible. Benefit and risk pass to you upon handover or delivery.

6. Prescription lenses

Prescription lenses (UltraFit) are made individually according to your prescription values and are therefore excluded from exchange and return. Orders are placed after personal advice; to arrange this, please contact us via the contact form or by phone.

7. Returns and exchanges

There is no statutory right of withdrawal in Switzerland. We voluntarily grant a right of return of 14 days from receipt of the goods: we take back unused products in unopened or undamaged original packaging against a refund of the purchase price. Individually manufactured prescription lenses as well as smart rings that have been worn for hygiene reasons are excluded. Please contact us before returning any item at sales@ai-eyewear.ch; you bear the cost of the return.

8. Warranty and guarantee

The statutory warranty rights under the Swiss Code of Obligations (Art. 197 et seq. CO) apply. In addition, there is a 2-year manufacturer's warranty in Europe. As your Swiss point of contact we support you with warranty claims. Even Realities' warranty terms apply. In the event of defects, please contact us at sales@ai-eyewear.ch or 078 422 46 73.

9. Retention of title

The goods remain our property until they have been paid for in full.

10. Liability

We are liable without limitation for damage caused by unlawful intent or gross negligence. Any further liability, in particular for slight negligence, indirect damage and consequential damage, is excluded to the extent permitted by law. Even Realities products are not medical devices.

11. Data protection

You can find information on the processing of your personal data in our privacy policy.

12. Applicable law and place of jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Zürich; mandatory statutory places of jurisdiction are reserved.
